What the panel ordered
AFFIRMEDp. 6
Defendant Liberty Mutual Insurance Corporation (LMIC) seeks reconsideration of the Findings of Facts issued by a workers’ compensation arbitrator (WCA) on December 2, 2020, wherein the WCA found that Liberty Mutual Insurance Policy No. W-C5-34S-516001-019 provides workers’ compensation insurance coverage for the Traverse City Beach Bums before the Workers’ Compensation Appeals Board in the State of California.
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
The Liberty Mutual policy, including the Residual Market Limited Other States Insurance endorsement, provides coverage for Traverse City Beach Bums in California because the contract of hire occurred in California, the employee performed temporary work there, and jurisdiction over the employer confers jurisdiction over the carrier.
From the decision · page 7This case comes before me on the issue of insurance coverage. The primary question was whether or not the Liberty Mutual insurance policy for the Traverse City Beach Bums provided coverage for that employer in the State of California
California has both subject matter and personal jurisdiction over Traverse City Beach Bums and thus over Liberty Mutual because the applicant signed his contract of employment in California and performed some work there.
