What the panel ordered
Petition for Reconsideration denied
Petition for Reconsideration of the Findings and Order issued by the WCJ on November 17, 2020
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
The petition was denied because the petitioner did not show significant prejudice or irreparable harm if removal was not granted, and reconsideration was deemed an adequate remedy.
From the decision · page 1We have considered the allegations of defendant's Petition for Removal or, in the alternative, Reconsideration, applicant's answer, and the contents of the Report of the workers' compensation administrative law judge (WCJ) with respect thereto. Based on our review of the record, we will deny reconsideration.
The facts that decided it
What the panel treated as outcome-determinative, and which side it favoured.
The Findings of Fact includes a finding of injury arising out of and in the course of employment, which is a threshold issue fundamental to the claim for benefits.
