From the decision · page 7Here, the WCJ found that cost petitioner interpreted a Compromise and Release for applicant not in connection with a board hearing, arbitration or deposition and that cost petitioner is not entitled to greater of market rate or Los Angeles County Superior Court rate per 8 CCR § 9795.3(b)(1). Based on our preliminary review, it is unclear whether the WCJ applied the correct analysis pursuant to AD Rule 9795.3(b)(1) or 9795.3 (b)(2).
