Petition for Reconsideration granted; Findings and Award affirmed except permanent disability amended to 59% without apportionment; attorney fees awarded at 15%
The WCJ's Findings and Order is rescinded and substituted with new Findings deferring the issue of serious and willful violation under Labor Code section 4553, and the matter is returned to the WCJ for further proceedings.
The WCAB amended the Findings and Order to strike Finding 5 but otherwise affirmed the WCJ's Findings and Order dated September 16, 2022, granting the petition to set aside the Compromise and Release and ruling that applicant is not required to reimburse the defendant any of the previous funds paid from the prior Order, with credit to defendant for benefits paid to date.
The WCAB panel denied the Defendant's Petition for Reconsideration and upheld the WCJ's Findings of Fact, Award, and Order that the applicant sustained injury due to serious and willful misconduct of the employer.
